IRS Levy
By assuming that you are a model American citizen, it should be safe to assume that you will never be exposed to the imposition of an IRS levy.
This is the last line the Internal Revenue Service will use to claim monies that is due to it.
Mistakes have been made in the past that have brought the awful spectre of the dreaded levy to bear on citizens who have dutifully paid their taxes, but, through an oversight of an IRS inspector have been subjected to the horror of losing all they have.
With accurate book-keeping, and an up to date income and expenditure filing system, it is possible to have the levy rescinded, but it is not advisable to try to do it on your own. A professional tax attorney or consultant knows all the angles and tactics the IRS are likely to use to try to cover the fact that they have made a mistake.
Of course, taking action only when the levy is imposed could be too late. Before the levy is applied, the IRS will inform the victim that they are imposing a tax lien. In short, this is a notification to the victim that the IRS is of the opinion that monies are outstanding, and that they, the IRS, intend collecting aforementioned monies.
For the innocent, this is the time to spring into action. The longer you leave it, the less innocent you appear, to the IRS at any rate, and the chances of reversal are also considerably reduced.
In the event that you are not such a model citizen, and you have not declared your full earnings from last falls’ garage sale because you’re really not sure how much profit you did make, or, even worse still, you have your own business and have not declared all your earnings, you may well have a problem. The IRS will not institute action against a taxpayer unless they are of the opinion that they have a strong case. The fact that very few people get through an IRS audit unscathed, bears testimony to this observation. Of course, the courts, though considered impartial, do tend to side with the IRS.
Would you be able to live with the shock and horror of being denied access to your home, having all your fixed assets removed from your possession, having a stranger legally drive your auto away, experiencing the humiliation of having to explain to your children that you owe the government money, standing in the street, in front of what used to be your most treasured belonging, knowing you can no longer call it yours, explaining to your spouse that you did do your returns correctly, knowing your neighbours, friends, and family may not really believe you when you tell them it’s all a mistake.
If you can live with the trauma of an IRS levy, ignore the notice of an IRS tax lien that arrives in the mail. If you cannot, don’t waste time, make an appointment with a tax professional, and avoid a pending IRS Levy. |
